Berry’s request was denied by a Superior Court a judge on August 1, according to court documents obtained.
Halle Berry’s application for a court intervention in her and Olivier Martinez’s co-parenting agreement for their nine-year-old son Maceo has been denied. Berry claimed that Maceo has not been attending a co-parenting coach as they had intended.
According to court documents obtained by PEOPLE at the time, on May 29, The Union actress, 57, and her ex-husband Martinez, 58, consented to “co-parenting therapy” with a counselor in order to “resolve disputes and conflicts between them in an effort to successfully co-parent” Maceo.
Berry is now claiming that Martinez has neglected to maintain his appointments with the coach. According to a new filing in the Superior Court of California in Los Angeles County that was obtained by PEOPLE on Thursday, Aug. 1, she alleged that Martinez “unilaterally terminated” coaching sessions without informing her or the coach.
She alleges in the filing that Martinez “has chosen to repeatedly violate agreements and court orders with careless regard,” and that his alleged “conduct harms” their son and the exes’ “already strained relationship.”
Berry requested that Martinez be required to attend at least one additional meeting before the conclusion of July and adhere to the previously discussed schedule in August. Berry requested that the court “enforce Olivier’s compliance” with the agreement by Monday, July 29.
Nevertheless, a request was denied by Judge Shelley Kaufman on Thursday due to a “lack of exigent circumstances,” as indicated in court documents obtained by PEOPLE. In other words, the magistrate did not consider it an imperative or emergency matter.
Berry stated in her filing that she and Martinez were required to complete their individual sessions before commencing joint sessions within two months of signing the agreement on May 29. The co-parenting therapist would subsequently make contact with the requisite third parties (such as their son’s school and therapists) during the course of the therapy.
“None of that has occurred,” the filing alleged. “In fact, not a single conjoint session has been scheduled and not a single third party has been contacted.”

The filing indicated that the sessions are conducted via Zoom, which means that the parties’ locations are irrelevant.
According to Berry, Martinez also allegedly “refuses to complete the necessary paperwork that would allow the coparenting therapist to speak to necessary third parties.” She accused Martinez of being the one to recommend co-parenting therapy as a tactic to “delay intervention at all costs” and “interfere with Halle’s relationship with Maceo without repercussion.”
Berry has ultimately accused Martinez of disrupting “the entire therapeutic process.”
Berry stated that she attempted to resolve the issue with Martinez and their respective attorneys prior to pursuing legal action.
Martinez and Berry finalized their divorce in August of last year. Berry will provide Martinez with $8,000 per month in child support and additional support equal to “4.3% of any income she receives above $2,000,000” under the terms of the agreement. Additionally, the two will share joint legal custody.
Berry initiated the divorce process in October 2015, following a two-year marriage.
“It is with a heavy heart that we have come to the decision to divorce,” the two said in a joint statement to PEOPLE. “We move forward with love and respect for one another and the shared focus of what is best for our son. We wish each other nothing but happiness in life and we hope that you respect our and, most importantly, our children’s privacy as we go through this difficult period.”
